PearPie Terms of Service

These terms govern your use of PearPie: the application, the PearPie Network, and any related services. By using PearPie, you agree to these terms. If you do not agree, do not use the service.

Where a term has significant legal consequences, we've tried to make that clear.

About our services

What PearPie provides

PearPie is an AI chat application that lets you:

• Run open-source AI models locally on your device, at no cost.
• Access premium AI models (such as Claude, Mistral, or DeepSeek) via the PearPie Network, using purchased credits.
• Sync data between your own devices via peer-to-peer connections.

What PearPie does not provide

PearPie is an interface and network, not an AI model provider. The AI models you access (whether local or premium) are created and maintained by third parties. PearPie does not control the outputs these models generate. All responses you receive through PearPie are generated by artificial intelligence. No human is on the other end of your conversations.

Minimum age

You must be at least 16 years old to use PearPie. If you are under 18, you must have the consent of a parent or legal guardian.

Your identity & public key

PearPie does not use traditional accounts. Your identity is a cryptographic key pair generated on your device. Your public key is your identity within PearPie.

Important: PearPie does not store, back up, or have access to your private key. You are solely responsible for safeguarding your key material and the devices it lives on. There are two practical consequences worth understanding:

• Conversations live on each device that holds them. They are stored locally on the device, not on a PearPie server. If the only device that has a given conversation is wiped or lost, that conversation is gone.
• Credits are tied to your private key. If the only device that holds your key is lost, those credits are not easily recoverable. PearPie technically could trace them back through payment records, but doing so means actively creating a persistent link between your payment data and your public key — exactly what the architecture is designed to avoid. We don't do this as a routine practice.

The simple way to avoid both situations is to link a second device. Once two of your devices are paired, your key (and your conversations) sync directly between them, so a single lost or wiped device isn't catastrophic.

Think of your private key like cash that lives on a particular device. Treat it accordingly.

Credits & payments

Purchasing credits

Premium model access requires credits, which you purchase through our payment provider (currently Stripe). By purchasing credits, you agree to the payment provider's terms of service in addition to these terms.

When you purchase credits, your public key becomes linked to a real-world payment identity through the payment provider. See our Privacy Policy for details on how this affects your pseudonymity.

Pricing & changes

Credit prices are displayed at the time of purchase. PearPie may change pricing at any time, but price changes will not affect credits you have already purchased. We will provide notice of significant pricing changes on our website.

Refunds

If something has gone wrong with a purchase, get in touch. Our default is to review the situation and try to make it right, not to refuse on principle. Write to legal@pearpie.ai with a quick explanation and we'll come back to you.

Your statutory rights under EU consumer protection law (including any applicable right of withdrawal under the Consumer Rights Directive) always apply on top of this, regardless of what we say here.

Payment records

PearPie and its payment provider retain transaction records as required by EU tax law and anti-money laundering regulations. These records cannot be deleted on request due to legal retention obligations. See our Privacy Policy for full details.

Acceptable use

You agree not to use PearPie to:

• Generate content that is illegal under applicable law.
• Generate content that sexually exploits or endangers minors.
• Harass, threaten, or incite violence against individuals or groups.
• Generate malware, exploits, or tools designed to cause harm.
• Impersonate others or misrepresent AI-generated content as human-authored where doing so causes harm.
• Systematically extract, scrape, or reverse-engineer PearPie or any AI model accessed through it.
• Use outputs for decisions with significant legal or material impact on individuals (such as credit, employment, housing, insurance, legal, or medical decisions) without appropriate human review.
• Engage in bulk, automated, or programmatic abuse of the PearPie Network.

Enforcement

Premium model requests are subject to automated content safety screening. PearPie does not manually review your conversations.

How it works

If a request is automatically flagged as potentially violating the Acceptable Use Policy, it will be blocked and a violation will be recorded against your public key. Flagged requests may be stored for enforcement and dispute resolution purposes (see our Privacy Policy).

Accumulation of violations may result in suspension of your access to the PearPie Network.

Disputes

If your access is suspended, you may dispute the suspension by contacting us within 30 days. We will review the flagged requests that led to the suspension.

• If your dispute is upheld, your access will be restored.
• If your dispute is not upheld, your access will remain suspended and any remaining credits associated with that public key will be forfeited.

Credit forfeiture upon confirmed violation is a contractual consequence of breaching these terms, not a penalty. You agree to this when you accept these terms.

AI outputs

AI models, whether running locally on your device or accessed via the PearPie Network, generate outputs based on statistical patterns. These outputs:

• May not be accurate, even when they appear confident.
• May contain errors, fabrications, or biased content.
• Should not be relied upon as a substitute for professional advice in legal, medical, financial, or other consequential domains.

You are solely responsible for evaluating the accuracy and appropriateness of any AI-generated content. PearPie does not warrant the accuracy, completeness, or fitness of any AI output for any purpose.

Your content

You own your inputs and outputs. PearPie claims no rights over your conversation content, because we never have it.

You grant PearPie no licence to your content. We do not use it, store it, or train on it.

PearPie and its associated branding, code, and design remain the intellectual property of PearPie.

Third-party model providers

Premium models are processed through providers with whom PearPie maintains data processing agreements. Your data does not leave PearPie's control. In certain cases, a provider may retain request data for a limited period for abuse prevention, after which it is automatically deleted. No data is permanently stored by any third-party provider.

PearPie is an intermediary. We provide the interface and network; the model providers generate the AI outputs. PearPie is not responsible for the content, quality, or behaviour of third-party models, though we select providers that align with our privacy standards.

Availability & changes

PearPie is provided "as is." We do not guarantee uninterrupted availability, specific uptime, or that any particular AI model will remain available.

We may modify, suspend, or discontinue any part of the service at any time. If we discontinue the PearPie Network entirely, we will provide reasonable notice and address outstanding credit balances.

Limitation of liability

To the maximum extent permitted by applicable law:

PearPie's total aggregate liability arising out of or relating to your use of the service shall not exceed the total amount you have paid to PearPie in the twelve (12) months preceding the event giving rise to the claim, or one hundred euros (€100), whichever is greater.

PearPie is not liable for indirect, incidental, special, consequential, or exemplary damages, including lost profits, data loss, or business interruption.

These limitations do not apply to liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded or limited under applicable EU law.

Termination

You may stop using PearPie at any time. There is nothing to "close" or "delete": your identity is your key, and your data is on your device.

PearPie may suspend or terminate your access to the PearPie Network if you violate these terms (see Enforcement above). Suspension affects your ability to use premium models; it does not affect local models running on your device. Your conversations remain yours regardless.

Governing law & disputes

These terms are governed by the laws of [JURISDICTION]. Any disputes arising from these terms or your use of PearPie will be subject to the exclusive jurisdiction of the courts of [JURISDICTION].

Nothing in these terms limits your rights under mandatory EU consumer protection law, including your right to bring a claim in the courts of your country of residence.

Changes to these terms

We may update these terms from time to time. Changes will be posted on our website with an updated effective date and a new version recorded in the version history. We will also notify you of updates through the PearPie application. Your continued use of PearPie after changes take effect constitutes acceptance of the revised terms.

For significant changes that materially affect your rights, we will notify you through a prominent in-app notice at least 30 days before the changes take effect. Material changes will require your explicit acknowledgment within the app before you can continue using premium services.

Each version of these terms is permanently retrievable from the version history, along with the SHA-256 hash of its canonical text, so what you agreed to remains verifiable.
